Tameka Foster’s Case Dismissed: Usher Maintains Custody of Kids

 


Usher and ex-wife Tameka Foster arrived in a Fulton County, Georgia, court on Friday for an emergency custody hearing regarding their two children. When all was said and done, the 34-year-old R&B singer maintained custody, but received a strict warning from the judge.
Awkward silence filled the courtroom as the two parties sat opposite each other waiting for the judge to enter the chambers and for the hearing to begin. The R&B star was dressed in a gray suit with a crisp white shirt buttoned to the top.

The couple was in court to continue their ongoing custody battle over their two children together, Usher Raymond V, 5, and Naviyd Ely Raymond, 4. On Tuesday, Usher Jr. was involved in an accident in which his arm got caught in a pool drainage pipe. He was rescued by a home contractor who successfully performed CPR on the boy.

While Foster was requesting temporary primary custody of her sons, Usher's attorney John Mayoue asked for a dismissal. "The children are not only better off with Mr. Raymond, they are thriving," he began. "The only new thing is the pool accident. We are asking that this emergency motion be dismissed. This is an effort by Ms. Raymond to gain publicity. … This is her sixth attempt to change custody. By my count she's on her 9th lawyer (in the past year)."

After a lengthy opening statement, the judge instructed Usher's counsel to move on to the emergency hearing at hand, rather than focusing on the larger custody discussion.

Usher's lawyer then gave a detailed description of the accident that occurred on Tuesday. He informed the court that the home where the accident happened was a house that Usher had recently starting renting. Some interesting details included the fact that the pool had just been cleaned earlier that morning and that Usher had thrown two parties for children at the house thus far without incident. He went on to call Usher Raymond V's Aunt Rena "a hero" for her quick actions following the accident.
Usher's counsel also pointed out that Foster's emergency motion claimed that Usher was out of town at the time of the accident, when in fact he was back at the house five minutes after it occurred. He added that Usher has canceled 87 concerts since being awarded full custody of his children last August, having performed live just six times in that period.
When Foster took the stand to testify, the line of questioning quickly turned to her thoughts on Usher's Aunt Rena and whether or not Tameka felt comfortable with her caring for their children.
She pointed out the fact that it took almost a full hour from the time of Usher Raymond V's accident for Usher to call her and that he told her that their son only had a cut on his arm and that's why he was on the way to the hospital. When she arrived at the hospital and learned that her son had suffered much more than just a cut, she said she broke down.
Foster noted that she has no knowledge of who the people are that are caring for her children when they're in her ex-husband's care. She described an incident on Father's Day when Usher Raymond V showed his mom a bad cut, and she claims Usher was unresponsive to her inquiries about how he got it. She also claimed that in the past few days, Usher has not been at the hospital with their son as much as she has.
She broke down and cried on the stand when the court played the 911 call from Aunt Rena on Tuesday. "I don't believe [Aunt Rena] has any control of the kids," she said on the stand at one point. Foster teared up again when describing the chaotic situation she envisioned after hearing the 911 call, and the judge eventually asked her to step down after she lost her composure.

Aunt Rena then took the stand and described the events as she remembered them from Tuesday afternoon. She claimed to know CPR, even though she hasn't been certified since initially learning it and didn't perform CPR on Usher Raymond Jr. following the accident. Foster's lawyer grilled her further on her professional qualifications to take care of children.
Then Foster took the stand again, and noted that Usher has not spent a single night at the hospital with his son this week. Then she was cross-examined by Mr. Mayoue, whose line of questioning focused on whether or not she actually had any first-hand account of the events that transpired on Tuesday. Thankfully, Foster kept her composure this time around.
Usher took the stand next, and was intensely cross-examined about why he didn't call Tameka for more than an hour after the incident occurred. He explained that he didn't call because he was dealing with handling the situation and its immediate aftermath and assessment. There was then significant questioning about Usher's knowledge of pool safety and his emergency contingency plans with his hired help and other family caregivers.
The judge then issued his ruling: "I'm not sure that any one person could have done better in this situation than [Aunt Rena]," he said, before dismissing Foster's case.
Though Usher retained custody of his two sons, the judge did give the R&B singer a warning.
"You would be well-advised to keep your former spouse better informed about your whereabouts … understand?" he asked.

It's hard to imagine someone not recognizing Oprah Winfrey -- but that's exactly what happened when the talk show host attempted to purchase a $35,000 Tom Ford bag at Trois Pommes in Switzerland last month.
Speaking to Entertainment Tonight on Monday, Aug. 5, the 59-year-old star of Lee Daniels' The Butler said she was denied service because the sales clerk didn't believe she could afford such a pricey purse. "I was in Zurich the other day at a store, whose name I will not mention, and I didn't have my eyelashes on, but I was in full Oprah Winfrey gear," she recalled. "I had my little Donna Karan skirt and my little sandals and all that on, but obviously The Oprah Winfrey Show is not shown in Zurich. This doesn't happen to me unless somebody obviously doesn't know it was me."

During her solo shopping trip, Winfrey asked the clerk to show her a luxury crocodile bag. "She says to me, 'No. It's too expensive.'" Winfrey asked to see it again, but the clerk once again denied her request, saying, "'No, no, no. You don't want to see that one. You want to see this one because that one will cost too much and you will not be able to afford that.'" Winfrey then said, "'No, I really did want to see that one.' And she refused to get it!"
The clerk proceeded to show Winfrey "these other little bags," but the star was unimpressed with the other options. "One more time, I tried. I said, 'But I really do just want to see that one.' And she said, 'Oh, I don't want to hurt your feelings.' I said, 'Okay, thank you so much. You're probably right. I can't afford it.' And I walked out of the store."

After Winfrey told her BFF Gayle King about the experience, King said she would have returned to the store and caused a scene a la Julia Roberts in Pretty Woman. The TV mogul, however, she didn't want to give the clerk commission.
"I could have had the big blowup thing and thrown down the black card and all that stuff," Winfrey said, "but why do that?"

Trudie Goetz, head of the Swiss luxury chain Trois Pommes, denies that Winfrey was discriminated against because of her race. "This is an absolute misunderstanding," she tells Us Weekly in a statement. "Any sales person would love to sell a crocodile bag. She simply explained [to Oprah] that the bag she wanted to look at was beautiful but in a very high price range and suggested lower priced models in leather, ostrich and so forth."
Goetz adds, "It was a misunderstanding. The staff member who welcomed Oprah is one of the hardest working and regularly deals with VIP clients. There was no discrimination."

In a separate statement to the BBC, Goetz said the employee in question is of Italian descent. "Of course, she speaks English, but not as well as her mother tongue," she explained. "It was a real misunderstanding." (Ironically, both Winfrey and Goetz were guests at Tina Turner's wedding celebration that same weekend.)
The Swiss Tourism Association also issued a statement saying it regrets the pain and embarrassment the experience caused Winfrey. "We are very sorry for what happened to her, of course, because we think all of our guests and clients should be treated respectfully, in a professional way," spokeswoman Daniela Baer told the Associated Press.

Chris Brown Suffers Seizure in Recording Studio

When the Los Angeles City Fire Department arrived, Brown, who experienced seizures as a child, refused to be taken to the hospital, TMZ reported.
Calls to Brown’s publicist and Record Plant were not returned, but the LAFD confirmed to E! News that an emergency call was placed from the studio at 1:09 a.m.
After the seizure scare, Brown’s on-and-off girlfriend, Karrueche Tran tweeted "Prayers all day." Seven hours later she tweeted again: "A lot on my mind today… I need a hug."

Oprah Winfrey Encounters Racism in Switzerland, Honored with Medal of Freedom

Oprah told she can't afford expensive bag while in Switzerland Oprah Winfrey has experienced the worst type of judgment and named as recipient of the highest civilian honor all within a few weeks: She was a victim of racism in Switzerland and will be awarded the Presidential Medal of Freedom along with former President Bill Clinton.

Oprah may be one of the wealthiest African-American women in the world, but when she took off to Switzerland for Tina Turner’s wedding she was actually told that a designer bag was much too expensive for her.
The Oprah Winfrey Show didn’t air in Switzerland, which means when Oprah stepped foot into an expensive boutique, the only thing any workers knew about her was that she was an African-American woman in a store where a small clutch bag might be $15,000 on clearance during a special holiday sale.
The bag that the media mogul was interested in had a price tag of $35,000, which is nothing for Oprah who made over $77 million last year. Despite Oprah having enough money to buy one of the $35,000 bags for everyone that used to sit in her live TV audience, the store clerk insisted that she needed to look at cheaper bag options and took her around the store to browse through tons of other options that didn’t cost nearly as much.
Finally Oprah had enough and she left the store without arguing or getting into any type of confrontation with the clerk.
“There’s two different ways to handle it,” she said. “I could’ve had the whole blow-up thing… but it still exists, of course it does.”

Oprah has been very vocal about her opinion of racism still existing, especially since she is starring in Lee Daniels’ new movie The Butler and her pal Paula Deen admitted to using the N-word.
One correspondent for the BBC claimed that the incident is nothing short of a “public relations disaster for Switzerland.”
While she may have been discriminated against in Switzerland, she will be getting honored in the U.S as President Barack Obama has listed her among the 16 recipients of the Presidential Medal of Freedom.
The award is the nation’s highest civilian honor that celebrates people who have made incredible efforts to promote national interests, world peace and other significant public or private endeavors.
It is essentially an honor that thanks individuals for making the world a better place through their hard work and charitable efforts.
Other recipients of the honor this year include former President Bill Clinton, singer Loretta Lynn, musician Arturo Sandoval, former executive editor for the Washington Post Ben Bradlee, baseball athlete Ernie Banks and scientist Mario Molina.
The honor is also being posthumously awarded to Daniel Inouye who fought in World War II with the 442nd Regimental Combat Team and was later elected to the Hawaii Territorial House of Representatives, U.S House of Representatives and the U.S Senate. He is also remembered as the first Japanese-American to serve in Congress.

Winnie Mandela Releases Memoir About Her Imprisonment Under Apartheid


Winnie Madikizela-Mandela has released her memoir, entitled “491 Days: Prisoner number 1323/69″ about her time in prison under apartheid. The ex-wife of former President Nelson Mandela said she felt like “the most unmarried, married woman.”
According to Mail and Guardian Online:
“Winnie Madikizela-Mandela’s new book, a collection of letters and diary entries from her 491 days in prison, is a powerful reminder of what she was best known for. A single mother, forced to raise her children alone after Nelson Mandela was sent to prison, she faced hunger and constant threats from the apartheid regime.
“The book, ’491 Days: Prisoner number 1323/69,’ is based on diary entries she made while in solitary confinement, awaiting trial for alleged acts of terrorism. This was in 1969. She was never convicted and throughout she says the regime was holding her and fellow prisoners to try to break their will, rather than to convict them.
“It contains letters sent between her and Madiba – although many were lost or delayed by many months. These give a gripping insight into a family trying to survive under an onslaught from the regime.
“The two were married in a ‘shabby little back veld church in Pondoland’ in front of a huge congregation. That was 1958. Winnie was 21 or 23, but she still does not know her real date of birth. In a prison letter to Madiba she says: ‘I recalled with all emotions and affection your reassuring and firm grip as you slipped the ring on my finger.’ She was five months pregnant.
“Soon after this, Madiba was arrested and put on trial. During this time he would wake very early each morning to commute from their home in Soweto to Pretoria for proceedings. The result was prison and Madikizela-Mandela was left to raise two young daughters alone.
“‘I was forced to mature on my own. Your formidable shadow which eclipsed me left me naked and exposed to the bitter world of a young ‘political widow,’ she wrote.
“In the introduction, Ahmed Kathrada, a close family friend, says: ‘Winnie’s life was virtually that of a single parent’ while her children had an ‘occasional father.’”

Tawana Brawley Forced to Compensate Male Victim in Elaborate Rape Hoax

Tawana Brawley PaymentsThe nation was stunned in 1987 by an African-American teenager’s accusation that she had been brutally gang raped by a group of white men, including a local prosecutor and a local police officer. Those accusations turned out to be an elaborate hoax — and decades later, one of the men wrongfully accused in the fabricated horrific crime is finally receiving reparations payments.

Eleven years after Tawana Brawley’s sensational story was disproved, former prosecutor Steven Pagones successfully sued Brawley, her attorneys and Rev. Al Sharpton — who had gotten involved with the case — for slander, according to the Poughkeepsie Journal. Although the others paid up, for years Brawley refused to pay the $185,000 in damages, worth closer to $400,000 with interest.
Brawley now works in Richmond, Va. as a nurse at the The Laurels of Bon Air nursing home, under a different name, Tawana V. Gutierrez, according to the Journal. A court has ordered Brawley’s employer to garnish her wages in order to begin paying Pagones.
So far, Pagones has received around $3,700, the Journal reports.
Brawley was just 15 years old when she told her family — and later reporters and police — that she had been raped by six white men, who scrawled racial epithets on her body and left her in a vacant lot, according to The New York Times. Her case, which was widely publicized by an up-and-comer named Sharpton — inflamed New York City, but was dismissed after a seven-month grand jury trial found her allegations unfounded, the Christian Science Monitor reports:
“The grand jury concluded that Tawana was not abducted, raped, or sodomized, noting that her sexual assault kit showed no evidence of such an attack and that physicians found no signs that she’d been outside in the woods for a prolonged time. The grand jury surmised that the teenager might have faked the attack to avoid punishment from her mother and stepfather for being absentee for several days. No charges were brought in the case.”
After years of living under the radar, Brawley and her family were tracked to Virginia several years ago, according to the New York Daily News. The Daily News found her parents in 2007 living in a rural area of the state, where they broke their silence in order to defend Brawley.
“How could we make this up and take down the state of New York? We’re just regular people,” Brawley’s mother Glenda told the Daily News. “We should be millionaires.”
Unfazed, Pagones and his lawyer Gary Bolnick decided to file for the wage garnishment in January, according to the New York Post. Pagones said he’s waited a long time for vindication, adding that it’s not simply about the money.
“It’s a long time coming,” Pagones told The Post in a recent interview. “Every week, she’ll think of me. And every week, she can think about how she has a way out — she can simply tell the truth.”
Still, Pagone and his attorney aren’t optimistic that Brawley will be able to come up with the cash.
“It’s not going to change anybody’s life,” Bolnick told the Journal. “The fact that she is forced to pay something is very important and very symbolic. It would be nice if she would pay off the entire judgment. Obviously, she’s going to make us work for that.”
